Terms of Service and Privacy Policy for PetScription
PetScription
Privacy Policy
Last updated: October 13, 2026
1. Who we are and what this policy covers
This policy explains how TailTech Inc. collects, uses and discloses your personal information through the PetScription app, associated website, communications and support services (“PetScription” or the “Services”).
We manage your personal information in accordance with Alberta’s Personal Information Protection Act and other applicable laws.
For the purposes of this Privacy Policy:
“Account” means your registered PetScription account;
“Pet Profile” means an animal's in-app profile; and
“Content” means records, photographs, messages and other material submitted through the Services.
Pet records, including your Account, Pet Profile and Content, can contain personal information about owners, former owners and other people. This policy applies to that information as well as personal information you provide about yourself.
This policy outlines the principles and practices we follow in protecting your personal information. By using the Services, you agree to the collection, use and disclosure of your information in accordance with this Privacy Policy.
2. Information we collect
While using the Services, we may collect personal information from you, automatically through your use of the Services and from third parties. Personal information we collect may include, but is not limited to the following categories:
| Category | Information |
|---|---|
| Account | Name, email address, password, user identifier, assigned in-app email address, optional photograph and subscription status. |
| Pet Profiles and Content | Pet details, photographs, clinic information and veterinary records. Documents may also contain people's names, addresses, contact details and financial or other personal information. |
| Communications | Recipient addresses, messages and attachments sent or received through the in-app mailbox, record requests and supporting correspondence. |
| Location | Location information, including precise coordinates, used by Google Maps/Places for clinic searches and maps. |
| Purchases and notifications | Subscription information and push-notification identifiers and contents, handled through third parties, such as RevenueCat, the Apple App Store, Apple Push Notification service and Firebase Cloud Messaging. We do not receive or store payment-card numbers through app-store purchases. |
| Website and technical information | Website analytics and associated cookies, IP addresses, device/browser details and service activity records. Google Analytics is used on the website, not in the app, subject to applicable consent choices. Vercel hosts the landing website. |
We receive information when you register, upload documents (including photographs of paper records), create a Pet Profile, request records, use location features, subscribe or contact support. We also receive it from clinics responding to requests, users sharing or transferring profiles, and service providers supporting these functions.
Clinic replies and attachments arrive in your in-app mailbox before being assigned to a Pet Profile. Record requests show your entered name and assigned email address, together with details you include. Check what you send and ensure you have authority to request or submit the records.
Contact us if information was submitted without authority or sent to the wrong Account.
3. How we use information we collect
We may use the information we collect about you to:
- Administer and authenticate Accounts;
- Store, organise and display Pet Profiles and Content;
- Send and receive requested correspondence and carry out sharing, transfers and professional archives;
- Display clinic searches and maps using Google Maps/Places;
- Recognise subscriptions, deliver service notifications and provide support;
- Protect the Services, investigate reported misuse and resolve technical problems;
- Understand use of our website through website analytics, subject to applicable consent choices;
- To operate, evaluate, develop, manage and improve our business, including operating, administering, analyzing and improving our Services, developing new products and services, managing and evaluating the effectiveness of our communications, conducting market research, aggregating or anonymizing data and performing data analytics, and performing accounting, auditing and other internal functions; and
- In other ways for which we provide specific notice at the time of collection or otherwise with your consent.
5. Consent and your choices
We explain the purposes of collection and seek consent where required. Information needed for a feature is distinct from optional uses. For example, an email address is needed to provide your Account and correspondence functions.
You can withdraw consent to a particular collection, use or disclosure on reasonable notice. We will stop the affected processing unless continued processing is permitted or required by law, and explain any applicable restriction or effect on the feature concerned. You do not have to delete your Account merely to withdraw consent to an optional use. Withdrawal does not retrieve copies already lawfully sent to others.
Device settings also control available location and notification permissions. Changing a setting does not erase information already collected.
6. Sharing, transfers and professional archives
The “Controlling Account” is initially the Account that created the Pet Profile and, after each accepted transfer, the recipient's Account. That is in-app control, not legal ownership of the animal.
Sharing. Shared users can view, add and update information in the selected Pet Profile, but cannot delete the Pet Profile or add further shares. Sharing has no automatic expiry. The holder of the Controlling Account can revoke shared access. Shared access also ends if the holder closes the Controlling Account or we terminate it under the Terms, even if the shared user has not breached the Terms. Ending shared access does not retrieve copies already obtained.
Transfers. When a recipient accepts a transfer, their Account becomes the Controlling Account and the sender loses live access. Reversal requires the recipient to transfer it back. Sharing it back restores access, not control. The Content associated with the selected Pet Profile and the sender's name accompany the transfer; personal information within documents is not automatically removed.
Professional archives. A user on the professional plan who transfers a Pet Profile keeps a snapshot taken at transfer, without later changes. A professional downgrade ends archive access at the end of the purchased period. Section 10 below explains recovery and deletion.
These product controls do not limit requests concerning your personal information under section 11.
7. Information we disclose
We may share information about you with third parties in order to conduct our business, when legally required, or with your consent, including:
| Recipient | Information and purpose |
|---|---|
| Clinics and recipients you select | Your requests, messages and attachments; shared or transferred Pet Profile information as described above. |
| Hosting, storage and email providers | Account information, Content and communications needed to operate the Services. |
| Map providers | Location and search information, including precise coordinates, needed for clinic lookup and maps. |
| App-store, subscription and notification providers | Information needed for app distribution, subscriptions, entitlements and push delivery. |
| Website hosting and analytics providers | Website hosting, a support-contact page for help recovering profiles, and website activity and technical information used to understand website use. |
| Governmental agencies | Information required to be disclosed to governmental or quasi-governmental requests, court orders, subpoenas or other legal process. |
We may share information to the following providers currently support the functions outlined in the following table:
| Provider | Use | Personal information | Where processed |
|---|---|---|---|
| Render | Backend API (api.tailtech.ca) | Yes | Oregon, USA |
| Railway | MySQL database | Yes | California, USA |
| Cloudflare R2 | Uploaded pet photographs, profile photographs and medical record files | Yes | Western North America / San Francisco |
| SendGrid / Twilio | Verification emails, password reset, and request/share-record emails | Yes | California, USA; sub processors in multiple locations in North America and the European Union |
| Firebase Cloud Messaging | Push notifications | Limited personal information | California, USA |
| RevenueCat | Subscriptions / entitlements | Limited personal information | Multiple locations in North America |
| Apple App Store / APNs | App distribution, in-app purchases and iOS push routing | Limited personal information | USA |
| Google Maps / Places | Clinic search, maps and place details | Location-related, including precise coordinates | California, USA |
| Google Analytics | Website analytics only, not in the app | Website activity, cookies and technical information | California, USA |
| Vercel | Landing website; support-contact page for help recovering profiles | Usually no app personal information | Multiple locations in North America |
Clinics and app stores also handle information under their own privacy notices. We remain responsible for information under our control when using service providers.
We may disclose information where authorised or required by law, including in response to valid legal demands or to address security incidents and protect legal rights.
Business transactions. Where legally permitted, we may disclose only personal information necessary to evaluate or complete a sale, merger or reorganisation of all or part of the business providing the Services. Recipients must first agree to protect its confidentiality and security, use it only for the transaction and restrict further disclosure as required by law. They must destroy the information if the transaction fails or, before completion, if it is no longer needed for the transaction.
After completion, the successor may retain only information needed to continue the affected business, under agreed safeguards, for existing permitted purposes and subject to privacy rights, including withdrawal of consent. Affected people will receive notice of the transfer and new holder within a reasonable time and as otherwise required by law. This does not authorise selling personal information as a product or new uses.
8. Processing outside Alberta and Canada
Personal information may be processed outside Alberta, including elsewhere in Canada, and outside Canada, including in the United States and, for some email subprocessors, the European Union.
Information processed abroad may be accessible to courts, law enforcement and other authorities under local law. We use contractual and other protections for information processed on our behalf.
Section 7 identifies the providers that currently support the Services and where they process information. For written information about these practices, including the countries and purposes, contact the person responsible for privacy using the details published on the PetScription website.
9. Safeguards
To prevent against unauthorized access, collection, use or disclosure of personal information, we use organisational and technical safeguards proportionate to the sensitivity of the information and the risks involved, including controls on access to Accounts and stored information.
In accordance with the applicable legislation, affected persons and/or regulators will be notified of privacy breaches. Keep your Account credentials private, take care when sending files outside the Services and contact us promptly about suspected unauthorised access.
10. Retention and deletion
We keep personal information only as long as needed for the purposes in this policy and as required by law.
Deleted Pet Profiles and professional archives. Contact support to request recovery within 30 days after you delete a Pet Profile or your professional-tier downgrade takes effect. Subject to the legal-retention exceptions below, material not restored through recovery is permanently deleted 40 days after said deletion or downgrade. You will retain your Account until Account closure is effected in accordance with the paragraph below. A timely recovery request pauses deletion until it is resolved, including completion of any approved recovery. If we restore the Pet Profile or archive, we stop its scheduled deletion. If we only provide a copy, the retained material remains scheduled for deletion. Section 15 of the Terms explains restoration, copies and verification.
Account closure. You can delete your Account in the app, which ends your access. Account deletion does not necessarily remove a profile transferred to another Account or copies a recipient independently retains.
Legal retention and your rights. We keep information longer where reasonably required for legal or business purposes.
11. Access, correction, export and complaints
You are entitled under the applicable legislation to request access to your personal information, and to request that an error or omission in respect of your personal information be corrected. Contact us to request access to and/or a correction to your personal information. We may verify your identity or authority. We respond within applicable legal time limits and explain lawful restrictions, including those protecting another person's information.
Some fields can be changed in the app. Contact support for help obtaining a copy of your information. We will use a suitable secure delivery method.
You may raise a privacy concern with us or complain to the regulator with jurisdiction, including the Office of the Privacy Commissioner of Canada or the Office of the Information and Privacy Commissioner of Alberta.
12. Younger users
Account users must be at least 16 years old and meet the eligibility requirements in section 2 of the Terms, including legal capacity where they reside.
Contact us if you believe a child's personal information has been submitted without required authority or consent.
13. Advertising and promotional communications
Before using personal information for targeting or disclosing it to an advertising provider, we will explain that processing and obtain any required consent. The presence of ads does not itself authorise access to veterinary records or other Content.
We send promotions only where permitted by law and provide a means to stop receiving them. Declining promotions does not prevent service messages such as password resets or replies to record requests.
14. Changes to this policy
We will date each update, publish a notice on our website and notify affected people by suitable means. We will give additional notice of material changes and obtain new consent where required.
15. Contact
If there are any questions regarding this Privacy Policy or our privacy practices, you may contact us using the information below:

PetScription
Terms of Service
Last updated: October 13, 2026
1. About these Terms
These Terms of Service (the “Terms”) govern the account, storage, sharing, record-request and related services provided by us through the PetScription app, associated website, and related services (“PetScription” or the “Services”). These Terms apply when you accept them at registration or through another acceptance step we present for the Services.
For the purposes of these Terms:
“Account” means your registered account;
“Pet Profile” means an animal's in-app profile;
“Content” means records, photographs, messages and other material submitted through the Services.
“Controlling Account” means the Account that created the Pet Profile and, after each accepted transfer of that Pet Profile, the recipient's Account.
Sharing, transferring and archiving a Pet Profile have different effects, summarized below. Sections 7-10 and 14-15 explain the effects of sharing, transfer, cancellation, downgrade and closure.
| Action | Main result |
|---|---|
| Share | Selected user may view, add and update; access can be revoked, but obtained copies cannot be recalled. |
| Transfer | Recipient controls the selected profile after acceptance. The sender loses live access unless the recipient later shares the profile back (access) or transfers it back (control). |
| Archive | Professional plan snapshot is read-only and separate from the recipient's live profile. |
2. Eligibility and Accounts
Each individual who registers or uses an Account must be at least 16 years old and have legal capacity to enter into these Terms where they reside.
You are responsible for providing accurate Account information, keeping it current and using an email address you control, protecting your password and reporting suspected unauthorized access. If you accept these Terms for an organization, you represent that you have authority to bind that organization, and in such cases, “you” includes that organization.
Subscribers to the professional plan (the “Professional Plan”) have access to added features. We do not verify professional veterinary qualifications of subscribers to the Professional Plan.
3. What the Services do
PetScription helps you organise pet information, upload records, request clinic records, and share or transfer Pet Profiles. It does not interpret medical records or provide a clinical assessment.
PetScription is not a veterinary practice, emergency service or substitute for your veterinarian's records. Do not rely on it to diagnose or treat an animal or decide whether urgent care is needed. Contact a veterinarian directly for clinical advice or in the event of an emergency. Information supplied by users or clinics may be incomplete, inaccurate or out of date and we make no representations or warranties regarding the accuracy, reliability or accessibility of the information supplied by other users or clinics to PetScription.
You are responsible for keeping originals and copies of important records where necessary, so that an interruption does not prevent you obtaining information needed for an animal's care.
4. Permission to use PetScription
While your Account is active, you may use the application and Account features for their intended purposes within your plan's limits. This permission is non-exclusive and is subject to suspension and termination under section 14. You may use supported sharing and transfer features, but shall not sell access or transfer your Account permission to someone else.
Our software, interface, branding and other supplied materials remain subject to our rights and those of our licensors. This permission does not transfer their ownership or authorise independent use of our names or logos. The app store's standard licensed-application end-user licence terms also govern your use of the downloaded application.
Except as permitted by applicable law or an applicable licence, you shall not copy, modify or reverse engineer our software or other supplied materials, or remove their ownership notices. This restriction does not limit authorised copying, sharing or export of your Content, including records you are entitled to obtain.
5. Your Content and authority
You retain whatever rights you have in your Content. You must have the authority or permission needed to provide it and direct the uses you request. Do not upload non-veterinary records, human medical records or other information you are not authorized to disclose.
You permit us and our service providers to store, copy, organise, display and transmit Content as reasonably necessary to provide the Services, including your record requests, sharing, transfers and supported archives. You permit us to retain authorised transferred copies and archives after your access ends where legally permitted or required, subject to privacy rights, including withdrawal of consent where applicable.
Personal information is handled as described in the Privacy Policy.
6. Clinic requests and the in-app mailbox
Your Account includes a mailbox, accessible only through the app, for requesting, receiving and sharing pet records. When making a request for pet records, such request identifies your entered name and assigned address, together with any details you add to your pet profile. It is your responsibility to ensure that the request is made to the appropriate recipient and that you are authorized to request the records.
Clinics decide whether to release pet records and may require identification, consent or further information. Clinic responses to requests are beyond our control and we do not guarantee that a response or complete records will be provided.
Check that received documents concern the correct animal before adding or sharing them. We may restrict or delete unsupported files. Messages, links and attachments may contain malware or phishing; receipt through PetScription does not certify authenticity or file safety. It is your responsibility to verify authenticity of communications before opening them. Responsibility for resulting losses is addressed in section 16.
7. Sharing a Pet Profile
Sharing a Pet Profile lets another registered user view, add and update information in the selected Pet Profile. A shared user cannot delete the Pet Profile or grant access to other users. It is your responsibility to check the recipient's identity and review records for personal information before sharing. Do not present your additions or corrections as clinic-made or clinic-approved.
Sharing has no automatic expiry. The holder of the Controlling Account can revoke shared access. Shared access also ends if the holder closes the Controlling Account or we terminate it under section 14, even if the shared user has not breached these Terms. Ending shared access prevents further access in the app, but we cannot recall copies that have already been obtained or sent elsewhere.
8. Transferring a Pet Profile
A Pet Profile can be transferred between Accounts. When a recipient accepts your transfer, that recipient's Account becomes the Controlling Account for the selected Pet Profile, and that person can share or delete it. On transferring the Pet Profile, you lose both access and control. You receive access again only if that Controlling Account later shares the Pet Profile with you. You regain control only if that Controlling Account later transfers the Pet Profile back to you.
The Content associated with the selected Pet Profile and the sender's name accompany the transfer. It is your responsibility to verify the recipient and review records, including personal information contained in the records, before confirming a transfer.
A transfer changes in-app control; it does not transfer legal ownership of the animal or copyright in the clinic records. Report a mistaken or unauthorised transfer promptly and as soon as possible. We may restrict access while reviewing a report of a mistaken or unauthorized transfer or granting of access to a Pet Profile.
9. Professional archives
The Professional Plan retains an archived read-only snapshot of a transferred Pet Profile. The archive shows the information contained in the Pet Profile at the time of transfer. It does not show later changes and does not give the user control of the recipient's live profile.
Users with the Professional Plan are responsible for retaining and using archived information only for authorized purposes. A downgrade from the Professional Plan ends archive access when it takes effect under section 10, subject to the recovery and deletion periods in section 15.
10. Subscriptions and billing
Your plan's features, limits, price, currency, billing interval, renewal terms, taxes and any trial or promotion are shown before purchase.
Cancellation and downgrade. For Apple App Store purchases, manage renewal and cancellation through the store's subscription settings. Cancelling renewal leaves your paid access in place until the purchased period ends. A voluntary downgrade takes effect at the end of the purchased period. Deleting the application or closing your Account does not itself cancel an app-store subscription. Where applicable law gives you a right to end the current contract early, you may exercise it through the supported route described at the time of purchase or by contacting support.
We will not change a price during a paid period already purchased. Renewal-price changes will be disclosed before taking effect, with the applicable choices and cancellation rights.
11. Acceptable use
Use the Services only for pet information and related record communications. You will not, and you will not permit anyone else to:
- upload unlawful, threatening, harassing or obscene material, or harm or deceive others;
- impersonate a clinic, user or authorised caretaker;
- request, access, share or transfer records without authority;
- send spam or unrelated bulk communications;
- upload malware, bypass access restrictions or interfere with the Services;
- scrape other users' information, disclose credentials or misuse shared access; or
- infringe intellectual-property or privacy rights.
You must have our express written consent for those to use the app for marketing purposes. Authorised animal care, adoption and related record communications remain permitted.
Report suspected abuse to support. We may investigate credible reports and act under section 14. We do not undertake to pre-screen Content or resolve every dispute between users.
12. Privacy, maps and third parties
Our Privacy Policy explains how we collect, store, use and disclose personal information and the choices available to you, and is hereby incorporated and forms a part of these Terms. Please review our Privacy Policy before using the Services.
Maps and clinic searches use third-party information. Check clinic details and availability directly where required. Links and listings do not establish that a provider is available or suitable for an animal's care. Third parties may have their own terms and privacy practices when you interact with their services. We make no representations or warranties regarding the accuracy, quality, or availability of third party services.
13. Advertising
Advertisements may appear on all plans, including paid plans. Advertisements are not veterinary advice. We make no endorsements, representations or warranties regarding the legitimacy, accuracy or quality of any products or services advertised through the app.
14. Suspension and ending access
Suspension. We may, in our sole discretion, temporarily suspend affected access when reasonably necessary to address an actual or alleged breach of these Terms, unauthorised Account access, security threat, or where otherwise legally required. On the same temporary and proportionate basis, we may block delivery, quarantine or restrict access to specific Content on reasonable grounds of a credible security threat, unlawful material or breach of these Terms.
Where practicable, we may, but shall not be obligated to, explain the reason and allow an opportunity to correct the issue.
Bypassing a suspension, including through another Account, may form grounds for termination.
Termination. We may, in our sole discretion, terminate access for a breach of these Terms. You may ask support to review any decision under this section. Retention of necessary incident information and permanent deletion remain subject to section 15, the Privacy Policy and applicable law.
Your Account closure. You may close your Account through the in-app account-deletion function. Closure, subscription cancellation and deletion of retained Content are separate processes addressed in sections 10 and 15.
Discontinuance. If we discontinue the Services, we will give reasonable advance notice and a reasonable opportunity to obtain available Content.
Quebec limits. For users in Quebec, we may end a fixed-term contract early only on grounds permitted under Quebec law. If the contract has no fixed term and you are not in default, we will give at least 60 days' written notice before ending it.
Refunds. If we terminate your paid access or discontinue a paid Service, including after a user breach, we will refund the unused prepaid portion, less only proven outstanding charges that we may lawfully deduct.
15. Access, export and deletion
Contact support for help obtaining available Content before deleting a Pet Profile, downgrading or closing your Account. It is your responsibility to ensure that copies are retained before requesting a cancellation, downgrade or deletion.
| Action | Effect |
|---|---|
| Cancel renewal | Paid access continues until the purchased period ends; renewal stops through the applicable store settings. |
| Voluntary downgrade | Takes effect at the end of the purchased period; Professional Plan archive access then ends under section 9. |
| Delete Pet Profile | Recovery may be requested within 30 days; the separate deletion process below applies to material not restored, subject to legal exceptions. |
| Delete Account | In-app access ends. Content a recipient controls after transfer, and copies already received elsewhere, are not necessarily deleted. |
For a deleted Pet Profile or an archive affected by a voluntary downgrade of a Professional Plan, contact support within 30 days of the profile deletion or downgrade's effective date to request recovery. Subject to the legal-retention exceptions below, material not restored through recovery is permanently deleted 40 days after downgrade or deletion. A timely recovery request pauses deletion until it is resolved, including completion of any approved recovery.
If we restore the Pet Profile or archive through recovery, we stop its scheduled deletion. If you only request a copy, the retained material will remain scheduled for deletion.
These recovery periods are subject to your legal access or correction rights. We keep information longer where required for legal or business purposes, as described in the Privacy Policy.
16. Service commitments and limits of liability
We will provide the Services with reasonable care. We do not promise uninterrupted availability, recovery of every deleted record or accuracy of information supplied by users, clinics or other third parties. Nothing in these Terms excludes a warranty, right or remedy that applicable law does not permit us to exclude.
Limitations of liability
Excluded losses.
EXCEPT AS EXPRESSLY SET FORTH IN THESE TERMS AND CONDITIONS AND TO THE FULLEST EXTENT PERMITTED BY THE LAW, WE PROVIDE THE APP AND THE SERVICES WITHOUT WARRANTY OR CONDITION OF ANY KIND. USE OF THE APP AND THE SERVICES IS AT YOUR OWN RISK. WE DO NOT MAKE ANY REPRESENTATIONS, WARRANTIES OR CONDITIONS, WHETHER EXPRESS OR IMPLIED, ABOUT THE MERCHANTABILITY, MERCHANTABLE QUALITY, QUALITY, ACCURACY, RELIABILITY, COMPLETENESS, CURRENCY, TIMELINESS, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THE APP, THE SERVICES OR THE CONTENT. THE APP, THE SERVICES OR THE CONTENT MAY INCLUDE ERRORS, OMISSIONS AND INACCURACIES. WE DO NOT ASSUME ANY RESPONSIBILITY FOR ANY ERRORS, OMISSIONS OR INACCURACIES IN THE APP, THE SERVICES OR THE CONTENT.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY AGREE THAT NEITHER TAILTECH INC., ITS SUPPLIERS, ITS AFFILIATES, NOR ITS DIRECTORS, OFFICERS OR EMPLOYEES SHALL BE LIABLE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHER LEGAL THEORY, FOR ANY DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, LOST PROFITS, LOSS OF USE, LOSS OF DATA, PERSONAL INJURY, FINES, FEES, PENALTIES OR OTHER LIABILITIES), WHETHER OR NOT TAILTECH INC., ITS SUPPLIERS, ITS AFFILIATES, OR ITS DIRECTORS, OFFICERS OR EMPLOYEES ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, RESULTING FROM THE USE OF, OR THE INABILITY TO MAKE USE OF, THE APP, THE SERVICES OR THE CONTENT.
WITH RESPECT TO ANY DIRECT DAMAGES, YOU AGREE THAT THE TOTAL AGGREGATE LIABILITY OF TAILTECH INC., ITS SUPPLIERS, ITS AFFILIATES, AND ITS DIRECTORS, OFFICERS AND EMPLOYEES IN CONNECTION WITH OR UNDER THESE TERMS AND CONDITIONS OR YOUR USE OF, OR INABILITY TO MAKE USE OF THE APP, THE SERVICES OR THE CONTENT, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF, OR INABILITY TO MAKE USE OF THE APP, THE SERVICES OR THE CONTENT IS LIMITED TO THE GREATER OF (A) FIFTY CANADIAN DOLLARS ($50) OR (B) AMOUNTS YOU’VE PAID TO US IN THE PRIOR 12 MONTHS FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM. FOR GREATER CERTAINTY, THE EXISTENCE OF ONE OR MORE CLAIMS UNDER THESE TERMS AND CONDITIONS WILL NOT INCREASE THE MAXIMUM LIABILITY AMOUNT.
THE LIMITATION ABOVE REFLECTS THE ALLOCATION OF RISK BETWEEN YOU AND THE COMPANY. THE LIMITATIONS SPECIFIED IN THIS SECTION WILL SURVIVE AND APPLY EVEN IF ANY LIMITED REMEDY SPECIFIED IN THESE TERMS AND CONDITIONS IS FOUND TO HAVE FAILED ITS ESSENTIAL PURPOSE.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
17. Changes to these Terms
We may make changes to these terms if, and to the extent, we deem necessary to reflect changes or updates to the Services or to reflect changing legal requirements. Where possible we will explain material changes and state the effective date through an Account notice and, where appropriate, email.
If you do not agree to a change, we will give you a reasonable opportunity to obtain a copy of your available Content, as described in section 14. If you elect not to continue the Services on the updated terms, section 14 shall apply. Your continued use of the Services confirms your acceptance of the revised Terms.
18. Contact, disputes and general terms
Contacts and notices.
Contact us, and send notices, using the support details published on the PetScription website.
Subject to applicable law, we may give notices through the app and by email to the address on your Account.
Governing law and disputes. These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the laws of Canada applicable therein, and any dispute in connection with these Terms or the Services shall be submitted to a court of competent jurisdiction in the Judicial District of Calgary, Province of Alberta, Canada. For users in Quebec, the laws of Quebec and the laws of Canada applicable therein govern these Terms, and any dispute in connection with these Terms or the Services shall be submitted to a court of competent jurisdiction in the City of Montreal, Quebec, Canada.
Transfer of this agreement. These Terms and any rights, licences and privileges granted by these Terms, may not be transferred or assigned by you unless in accordance with these Terms or without our express written consent. We may assign or transfer these Terms without restriction and without notice to you.
Entire agreement.
These Terms, the Privacy Policy and any other terms and conditions that you agree to are the entire and exclusive agreement between TailTech Inc. and you regarding the Services and supersede and replace any prior agreements, whether oral or in writing, between TailTech Inc. and you regarding the Services.
If a provision cannot apply. If any provision of the Terms shall be declared unlawful, void or for any reason, unenforceable, then that provision shall be deemed severable from the Terms and shall not affect the validity and enforceability of any remaining provisions.
After Account closure or termination.
Closing or deletion of your Account does not cancel amounts already owed or affect claims arising before closure or deletion.
Section 16, including all its exclusions and exceptions, survive closure or deletion and continue to apply after closure or deletion.
